Abstract:

In 1976, The Institute for Public Interest Representation of the Georgetown University Law Center in Washington, D.C. (INSPIRE), published a study on the history of appointments of commissioners to the Federal Trade Commission and the Federal Communications Commission. Appointments to the Regulatory Agencies: The Federal Communications Commission and the Federal Trade Commission (1949-1974), examined regulatory appointments over 25 years and five administrations. Inclusive dates for the INSPIRE Records span from 1935 to 1976, although the bulk of the material dates from 1973 to 1976. The collection contains published information and unpublished information on the men and women appointed to the Federal Trade Commission and the Federal Communications Commission from 1949 to 1974 including among others, Joseph Califano, Benjamin Hooks, Nicholas Johnson, Newton Minow and Caspar Weinberger. One part of the collection includes materials copied from the files of the Senate Committee on Commerce at the National Archives, the House Oversight & Investigations Subcommittee, the Harry S. Truman, Dwight D. Eisenhower and John F. Kennedy Presidential Libraries, the papers of columnist Drew Pearson, and the papers of Senator Estes Kefauver. Records documenting the efforts by INSPIRE to produce their report make up the other part of the collection. Types of documents include correspondence, manuscript notes, written interviews, maps, graphs, photographs, charts and transcripts of 39 oral interviews. 53 audio tape cassettes make up part of the Collection but are stored separately with the Audio Tape Collection of the Library of American Broadcasting.

Historical Note

In 1976, The Institute for Public Interest Representation of the Georgetown University Law Center in Washington, D.C. (INSPIRE), published a study on the history of appointments of commissioners to the Federal Trade Commission and the Federal Communications Commission. Appointments to the Regulatory Agencies: The Federal Communications Commission and the Federal Trade Commission (1949-1974), examined regulatory appointments over 25 years and five administrations. Events and details of 51 appointments were investigated and the result was an analysis of how regulatory appointments are made. The study was authorized jointly by the Senate Committee on Commerce, chaired by Sen. Warren G. Magnuson, and the Senate Committee on Government Operations, chaired by Sen. Abraham Ribicoff, to assist them in their efforts to reform the appointments process. James M. Graham and Victor H. Kramer directed the study, which was funded by The Ford Foundation.

Scope and Contents of the Collection

The INSPIRE Records are papers of the Institute for Public Interest Representation of the Georgetown University Law Center that pertain to the study, Appointments to the Regulatory Agencies: The Federal Communications Commission and the Federal Trade Commission (1949 -1974). Inclusive dates for the material span from 1935 to 1976, although the bulk of the material dates from 1973 to 1976.

Custodial History and Acquisition Information

The materials in this collection were donated to the Broadcast Pioneers Library in May 1976 by James H. Graham, co-author of the study.

Detailed Description of the Collection

Series 1: Interviews, 1935-1976 (6.50 linear feet)

Series I contains a file folder for each Commissioner interviewed by INSPIRE or discussed in the study. These files are arranged in alphabetical order and include: correspondence, background notes (articles from newspapers, trade journals, The Congressional Record, and published biographies), published remarks, transcripts of the interview, notes about the interview, and the signed approval form for attribution including any changes to the manuscript made by the Commissioner.

Series 2: Background Research for the Study, 1935-1976 (2.00 linear feet)

INSPIRE started their study in 1972 with the expectation of writing an article on the subject of regulatory appointment reform but soon found they needed to expand their efforts and produce something more substantial. Series II contains records documenting the research and production of the study. Materials in this series include correspondence, organizational files and notes, historical background materials, chapter notes, a copy of the final report, and miscellaneous items such as charts and photographs.

This subseries contains the records of INSPIRE concerned with the organization of the study. Materials include, among others, general correspondence, ideas on organization, interview dates, information on presidential libraries, and a description of the study.

The Chart, labeled "The Succession of Commissioners at the FTC, depicts the length of time a Commissioner served on the FTC and when they left, starting with 1915 and ending in 1966.
